Google produces certified records that confirm that emails presented by Venezuelan government officials as proof of presidential assassination plot do not reside in Gmail’s servers.

E-forensics expert concludes that emails related to Pedro M. Burelli are falsified

“...all of the objective, verified evidence is consistent with the falsification of the Emails related to Pedro Burelli in the Venezuelan Government Report.”

(Washington DC, July 01, 2014) - After being served on Monday, June 16th, with a subpoena duces tecum, on June 27th, Google produced, extensive and certified records fully responsive to that subpoena.

[An abridged copy of the subpoena duces tecum is attached]

Upon evaluation, the three Emails purportedly written by Pedro Mario Burelli, and which were presented as supposed evidence of wrongdoing on May 28th by a group of high ranking Venezuelan government officials, were not found to be present on Google’s servers, even though at least one Email was allegedly sent two days before that event, making it a near-impossibility that it could have been purged from Google’s system in that short a time.

This conclusion supports Mr. Burelli’s rejection of what he termed “farcical and defamatory charges”.

In order to evaluate Google’s certified production, Mr. Burelli’s lawyers retained the services of e-Forensics firm Kivu Consulting. The forensics specialists compared Google’s records with the emails contained in an official Venezuelan government brochure in PDF format titled “Coup d’état and Assassination Plan Unveiled in Venezuela.” On June 30th, Winston Krone, Esq., Managing Director of Kivu Consulting, presented a report where he observes that:

  1. The “Emails” in the Venezuelan Government Report are clearly mock-ups and do not reflect actual screen shots
  2. Verified records from Google show no evidence that these Emails ever existed
  3. Verified records from Google confirm that a 2011 Email exists which contains lines of text that are identical to an alleged 2013 Email from the Venezuelan Government Report

And then Mr. Krone concludes:

In sum, all of the objective, verified evidence is consistent with the falsification of the Emails related to Pedro Burelli in the Venezuelan Government Report. If the Venezuelan Government does not offer evidence authenticating the Emails, no objective forensic analyst could conclude that the Emails referenced in the report are genuine.

Violating due process and illegally breaching the legal mandated confidentiality of an ongoing criminal investigation, a self-proclaimed “Alto Mando Politico de la Revolución” (High Political Command of the Revolution), consisting of ten high ranking Venezuelan government officials, put on a mid-day televised spectacle in which they produced these Emails as ‘indisputable proof’ of Mr. Burelli’s involvement, along with National Assembly Deputy Maria Corina Machado, Henrique Salas-Romer, Diego Arria (and others) in a plan to assassinate President Maduro and thus provoke a coup d’état.

Once the report by the forensics expert was released, Mr. Burelli stated, "I was challenged - derisively - to deny authorship of the Emails. I did that immediately via Twitter and on a series of widely seen TV interviews. And, even though the burden of proof lies with the accuser, I initiated steps to get to where we are today. Those Emails were fabricated, and I will bet that the same is the case for the other four Emails used to vilify and persecute a group of Venezuelans critical of the Maduro administration.”
Finally, based on this flimsy evidence, the Prosecutor General in Venezuela summoned the alleged conspirators including Mr. Burelli. On June 11th, though never properly summoned, the Prosecutor ordered INTERPOL arrest warrants against Mr. Burelli. As a resident of the United States, Burelli had to be summoned according to long established procedures, which were willfully ignored.
On this matter Mr. Burelli stated, “Even though they knew the Emails were fabricated, they issued faulty summons and then arrest warrants abusing INTERPOL procedure since their objective is to tarnish the reputation of all who openly oppose them. With my lawyers, I am studying all possible avenues to seek remedy for the damage done to my reputation."
When reflecting on this entire episode, Mr. Burelli concludes:

"My first reaction was shocked amusement. How could the government be so sloppy and irresponsible? But, If they could do this to me, and others that have the means to defend ourselves, imagine what they are willing to do to those who for one reason or another are condemned to live every day under the false justice of this inept and corrupt government. The resignation of Nicolas Maduro appears to be a necessary step to retrace our steps towards liberty, prosperity and a fully functioning democracy.”
